GST Council Meeting updates for the F.Y 2020-21 as per the last and latest meeting held under the Chairpersonship of the Hon’ble Union Finance Minister, Smt. Nirmala Sitharaman.

39th GST Council Meeting

The Thirtynineth meeting of the GST Council was held on 14 March 2020 in New Delhi under the Chairpersonship of the Hon’ble Union Finance Minister, Smt. Nirmala Sitharaman.

1. The implementation of the new GST return system has been postponed to 1st October 2020.
2. the implementation of e-invoicing and the QR code has been postponed to 1st October 2020.
3. The present return system (GSTR-1, GSTR-2A & GSTR-3B) will be continued until September 2020.
4. The GSTR-9 & 9C deadline is extended to 30 June 2020 for FY 2018-19.
5. Now the filing GSTR-9C is optional for the taxpayers having the turnover less than Rs 5 crore. Because the turnover limit has been increased from Rs 2 crore to Rs 5 crore for mandatory annual return filing.
6. The taxpayers with an aggregate annual turnover of less than Rs 2 crore in FY 2017-18 and FY 2018-19 will not pay any late fee for delayed filing of GSTR-9.
7. A new scheme called ‘Know your Supplier’ has been introduced so that the taxpayers are informed about the basic details of the suppliers.
8. The due date of Form GSTR-3B for July 2019 to January 2020 is extended till 24th March 2020 for taxpayers with a principal place of business in the Union Territory of Ladakh
9. The extension is a one-time measurement to facilitate those who want to continue conducting the business. hence the Taxpayers who have cancelled their GST registration till 14th March 2020 can file an application for revocation of cancellation of registration. The window to fill this application is available till 30th June 2020.
10. The GSTR-1 for 2019-20 will be waived for certain taxpayers who could not opt for the special composition scheme (notification No. 2/2019-Central Tax (Rate) dated 7th March 2019) by filing Form CMP-02.
11. To curb fake invoicing and fraudulent passing of ITC. In the case of new GST registrations, restrictions to be imposed such as physical verification of the premises and financial KYC of the registered person.
12. The time limit for finalisation of the e-Wallet scheme for consumers is extended till 31st March 2021.
13. A transition plan is laid down till 31st May 2020 for the taxpayers belonging to Dadra and Nagar Haveli & Daman and Diu, due to the merger in January 2020.
14. Present IGST and cess exemptions on the imports made under the AA/EPCG/EOU schemes will continue up to 31st March 2021.
15. Refund claims will now be processed in bulk for the benefit of the exporters.
16. GST on maintenance and repair overhaul services of aircraft slashed to 5% from 18%
17. And GST on mobile phones, specified parts increased to 18% from 12%.
18. GST on handmade, machine-made matchsticks rationalised to 12%.

38th GST Council Meeting

1. Grievance Redressal Committees (GRC) will be constituted at Zonal/State level with both CGSTand SGST officers and including representatives of trade and industry and other GST stakeholders (GST practitioners and GSTN etc.). These committees will address grievances of specific/ general nature of taxpayers at the Zonal/ State level.
2. The due date for annual return in FORM GSTR-9 and reconciliation statement in FORM GSTR-9C for FY 2017-18 to be extended to 31.01.2020.
3. Following measures would be taken to improve filing of FORM GSTR-1:
   (i) waiver of a late fee to be given to all taxpayers in respect of all pending FORM GSTR-1 from July 2017 to November 2019, if the same is filed by 10.01.2020.
   (ii) E-way bill for taxpayers who have not filed their FORM GSTR-1 for two tax periods shall be blocked.
4. Input tax credit to the recipient in respect of invoices or debit notes that are not reflected in his Form GSTR-2A shall be restricted to 10 per cent of the eligible credit available in respect of invoices or debit notes reflected in his Form GSTR-2A.
5. To check the menace of fake invoices, suitable action to be taken for blocking of fraudulently availed input tax credit in certain situations.
6. A Standard Operating Procedure for tax officers would be issued in respect of action to be taken in cases of non-filing of FORM GSTR 3B returns.
7. Due date of filing GST returns for the month of November 2019 to be extended in respect of a few North Eastern States.
8. The Council also approved various law amendments which will be introduced in Budget 2020.

The 33rd Meeting of the GST Council was held on 20th February 2019 through video conferencing during which Agenda items 1- 4 and6 were discussed and decided. For Agenda items 5 (Recommendations of the GoM for boosting Real Estate Sector under GST regime) and 7(i) (Interim report of GoM on Lottery), after discussion, it was decided that the same would be discussed in a physical meeting to be held in Delhi on 24th February 2019.
